1. Introduction
These Terms and Conditions govern the use of the MatzoTech (Pty) Ltd website at matzotech.com (“Website”). By accessing or placing an order on the Website, you agree to be bound by these Terms and Conditions. MatzoTech (Pty) Ltd (Registration No: 2020/762041/07, VAT No: 4580302760, located at Crossfire Place, 15 Gardner Williams Ave, Paardevlei, Somerset West, 7130, South Africa) reserves the right to amend these Terms and Conditions at any time, with updates posted on the Website.
2. Definitions
• Company: MatzoTech (Pty) Ltd.
• Customer: Any individual or entity visiting the website or purchasing services or products from the Website.
3. Services and Product Information
3.1 Descriptions
All Services and Products are described on the Website to the best of MatzoTech’s ability. MatzoTech is not liable for errors or omissions in descriptions, images, or pricing, and reserves the right to correct such errors without liability.
4. Pricing and Payment
4.1 Pricing
Prices are subject to change without notice, but the price displayed at the time of order confirmation applies to that order.
4.2 Payment
Payment must be made in full at the time of purchase via the payment methods available on the Website (e.g., credit/debit card, EFT, Tokens, Crypto). MatzoTech uses secure payment gateways to protect Customer data. MatzoTech is not liable for any errors or delays caused by third-party payment processors.
Full payment is required upon project completion, prior to the website going live. Invoices are typically sent via email, but the Client may opt for hard copy invoices. Payment is due upon receipt of the invoice. Accounts unpaid thirty (30) days after the invoice date will incur a service charge of ten percent (10%) per month on the outstanding balance, including interest of two percent (2%) per month.
In the event that an invoice remains unpaid 60 days after it’s issuance, services will be temporarily suspended until full payment is received. If the account remains outstanding after 90 days, services will be permanently terminated.
5. Cancellation of Orders
Customers may cancel orders by contacting onlineshop@matzotech.com. MatzoTech may cancel orders due to third-party service unavailability, pricing errors, or suspected fraud, with a full refund issued to the Customer.
6. Limitation of Liability
MatzoTech’s liability for Services or Products supplied is limited to the amount paid by the Customer for the specific Service or Product. MatzoTech is not liable for indirect, incidental, or consequential damages, including but not limited to loss of data, profits, or business opportunities, arising from the use or inability to use the Services or Products. MatzoTech is not responsible for failures caused by third-party services.
7. Data Protection and Privacy
MatzoTech processes personal information in compliance with the Protection of Personal Information Act (POPIA) No. 4 of 2013, and in compliance with the laws in any area that it operates. Customer data (e.g., names, contact details, payment information) is used solely for order processing, delivery, and customer support. MatzoTech’s PAIA Manual, available through the matzotech.co.za Privacy Policy page, provides details on data processing and access. Customers may contact marketing@matzotech.com to request access to their personal information.
8. Force Majeure
MatzoTech is not liable for delays or failures to perform due to events beyond its reasonable control, including but not limited to natural disasters, cyberattacks, power outages, or third-party service failures.
9. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of South Africa. Any disputes shall be resolved through mediation in Cape Town, South Africa, before proceeding to arbitration or litigation, in accordance with the Consumer Protection Act and other applicable laws.
